Van Osdol works closely with companies and individuals in real estate matters of all commercial, agricultural, and multifamily types, from lease negotiations to financing transactions to landlord tenant issues. Our experienced team of attorneys is ready to help you succeed in every aspect of your real estate endeavors.
Acquisitions and Sales. We negotiate, manage due diligence, and document purchase-and-sale transactions in all property types: office, industrial, multi-family, retail, and agricultural. We also have experience buying and selling unusual assets that don’t fit neatly within a category. Our attorneys understand the unique opportunities and additional risks associated with assets built for entertainment, recreation, education, and other specialized uses. We can handle portfolio and programmatic acquisitions, and we are well-equipped to help the “quiet buyer,” who is active in the market without drawing attention to its identity or its activity.
Leasing and Property Management. From developing forms for a multi-tenant property manager to negotiating long-term triple-net and build-to-suit leases, Van Osdol’s attorneys can represent both landlords and commercial tenants in all aspects of leasing. We also are experienced in drafting, negotiating, and reviewing all types of agreements associated with real estate operations, from property management, brokerage, and service agreements to operating covenants, restrictions, reciprocal easements, and tenancy-in-common agreements.
Debt and Equity Financing. Van Osdol represents lenders and borrowers in commercial bank, life insurance, mezzanine and non-traditional real estate lending. We work with asset managers to build equity structures for new investments, and we help family office and high-net worth clients evaluate the risks in real estate opportunities presented to them. Our attorneys also have expertise financing through REIT structures.
Zoning, Entitlement and Incentive Matters. We work with property owners and developers to determine current zoning and entitlement status and potential issues associated with planned improvements or changes of use. We can also help clients determine the availability of economic incentives for certain development, business recruitment, and expansion projects, and through our affiliates, we can help advance incentive requests through proper political channels.
Construction. We represent building owners, subcontractors, and small-to-midsize general contractors in negotiating design and construction project contracts, with experience in AIA, AGC, and custom forms, both for design-build and traditional projects.
Real Estate Disputes. From time to time, litigation threats and actual lawsuits, arise. Van Osdol attorneys have the experience necessary to advise and represent clients faced with becoming a plaintiff or defendant in potential litigation on real estate matters, from zoning and entitlement challenges to contract disputes.
