In November 2019, Van Osdol obtained a “no liability” verdict for Central Mine Equipment Company, a leading drill rig manufacturer near St. Louis, Missouri. The Plaintiff suffered an amputation when performing maintenance on the rig’s running power unit. In his closing argument, Plaintiff asked the jury to award $3.1 million for his amputations, PTSD, injuries to his shoulder, neck and back.
In Missouri product liability cases, the jury is usually asked to allocate fault among the parties who are at trial. In this case, the jury was asked to allocate a percentage of fault between CME and the Plaintiff. Their verdict assigned 0% fault to CME and 100% fault to the Plaintiff.
